Terms of service
TERMS OF SERVICE
Last updated: 25 August 2026
OVERVIEW
Welcome to Honey & Paw. The terms "we", "us" and "our" refer to HONEY & PAW LTD, a company registered in England and Wales with company number 17331353, trading as Honey & Paw. We operate this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Honey & Paw is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights and cover areas such as delivery, cancellation, returns, warranty disclaimers and limitations of liability.
By visiting, interacting with or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy (https://honeyandpaw.com/pages/privacy-policy). If you do not agree, you should not use or access the Services.
We sell to customers in the United Kingdom, the United States and Australia. Some of your rights depend on where you live, and we have set those differences out clearly where they arise. Nothing in these Terms removes or limits any right you have under the consumer protection laws of the country in which you live.
In these Terms, "consumer" means an individual who is buying wholly or mainly for personal use rather than for use in connection with a business.
SECTION 1 - ACCESS AND YOUR ACCOUNT
You must be at least 18 years old to purchase from us or to create an account. By agreeing to these Terms of Service, you confirm that you are at least 18. If you allow a minor in your care to use the Services on a device you own, purchase or manage, you are responsible for their use of the Services and for any orders placed.
To use the Services, including browsing our online stores or purchasing any of the products we offer, you may be asked to provide certain information, such as your email address and your billing, payment and delivery details. You confirm that all information you provide is correct, current and complete, and that you have all rights necessary to provide it.
You are responsible for keeping your account credentials secure and for activity that takes place under your account. You may not transfer, sell, assign or license your account to anyone else. Please tell us promptly at contact@honeyandpaw.com if you believe your account has been used without your permission.
SECTION 2 - OUR PRODUCTS
We make every effort to describe and picture our products accurately. Colours and product appearance may still differ from how they look on your screen because of your device type, display settings and configuration. Product images are for illustration, and packaging may vary.
Product dimensions, weights and capacities are given as a guide and may vary slightly within normal manufacturing tolerances.
Descriptions of products may change at any time at our discretion. We may discontinue any product at any time and may limit the quantities of any product we offer to any person, geographic region or jurisdiction on a case by case basis.
Nothing in this section affects your statutory rights, including your right to receive goods that match their description. Those rights are set out in Section 13.
SECTION 3 - ORDERS AND WHEN A CONTRACT IS FORMED
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion, including where the product is unavailable, where there has been a pricing or description error, or where we suspect fraudulent or unauthorised activity.
Your order is not accepted until we confirm acceptance. Our order confirmation email is an acknowledgement that we have received your order, and a contract is formed between you and us when we send you a dispatch confirmation email for the items in that order. Where an order contains several items, a separate contract is formed for each item as it is dispatched. We must receive and process your payment before an order is accepted.
Please review your order carefully before submitting it. Once an order has been accepted, we may be unable to stop it before dispatch. This does not affect your right to cancel under Section 11 or your rights under Section 12 and Section 13.
If we do not accept an order, make a change to it, or cancel it, we will attempt to contact you using the email address, billing address or phone number you gave at the time of ordering. If we cancel an accepted order, we will refund you in full.
You confirm that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 - PRICES, TAXES AND PAYMENT
Prices, discounts and promotions may change without notice. The price charged will be the price shown at the time you place your order and confirmed in your order confirmation email.
Prices are shown in the currency you have selected. Where you are shopping in a currency other than the one in which we are billed, the amount charged by your card issuer may differ slightly because of exchange rates and any fees your issuer applies. Those fees are a matter between you and your payment provider.
Whether tax is shown in the displayed price depends on your delivery destination:
United Kingdom: we are not currently registered for VAT, so no VAT is charged on your order and we are unable to issue VAT invoices. The price shown is the total price payable for the goods. Delivery charges are shown separately at checkout.
Australia: we are not currently registered for Australian GST, so no GST is charged on your order. Delivery charges are shown separately at checkout.
United States: we do not currently collect US sales tax, so no sales tax is added at checkout. Depending on your state, you may be responsible for reporting and paying any use tax due on your purchase.
Unless we state otherwise, displayed prices do not include delivery charges, customs duties or import charges. The total amount payable is always shown before you complete your purchase.
Prices in our online stores may differ from prices offered in physical stores or by other retailers, including other stores that sell our products.
You agree to provide current, complete and accurate purchase, payment and account information, and to update it promptly so that we can complete your transactions and contact you if needed.
You confirm that: (a) the payment information you provide is true, correct and complete; (b) you are authorised to use the payment method for the purchase; (c) charges you incur will be honoured by your payment provider; and (d) you will pay the charges you incur at the posted prices, including delivery charges and all applicable taxes.
We accept the payment methods shown at checkout. Payments are processed securely by Shopify Payments and other third party payment providers. We do not store full payment card details.
SECTION 5 - KLARNA AND OTHER BUY NOW PAY LATER PROVIDERS
We may offer buy now pay later or instalment payment options at checkout through third party providers such as Klarna. Availability varies by country, by order value and by product.
If you choose one of these options, you enter into a separate agreement directly with that provider. We are not a party to that agreement. The provider's own terms, eligibility criteria and privacy policy apply, and you should read them before you proceed.
Approval is not guaranteed. The provider will carry out its own checks and may decline your application. We have no control over, and no responsibility for, that decision.
Using a buy now pay later or instalment product may involve a credit check, may be recorded on your credit file, and late or missed payments may result in fees charged by the provider and may affect your ability to obtain credit in future. Any questions about your instalment plan, payment dates, fees or account should be directed to the provider.
Where you have paid using one of these providers and we owe you a refund, we will refund the provider, and the provider will apply the refund to your plan in line with its own terms.
Nothing in this section affects your rights against us in relation to the goods themselves, which are set out in Section 12 and Section 13.
SECTION 6 - PROMOTIONS, DISCOUNTS AND FREE DELIVERY
From time to time we run promotions, discount codes and offers. Unless we state otherwise when the promotion is advertised, the following rules apply.
General rules
One discount code may be used per order. Discount codes cannot be combined with each other.
Automatic promotions, such as our bundle offer, apply at checkout and cannot be combined with a discount code unless we say otherwise.
Promotions apply only while advertised and while stocks last. We may withdraw or change a promotion at any time before you place your order.
Discount codes have no cash value and cannot be exchanged for cash or credit.
Discount codes cannot be applied to gift card purchases.
We may cancel an order and withdraw a discount where a code has been used fraudulently, has been obtained other than through an official Honey & Paw channel, or is used in breach of these Terms.
Welcome offer
Our welcome offer gives 10% off a first order when you sign up to our email list. It is limited to one use per customer, per email address and per household. It applies to full price items only and cannot be combined with other discount codes. It does not apply to gift cards.
Bundle offer
Our bundle offer gives 20% off when you add four or more qualifying items to your basket. The discount applies automatically at checkout to qualifying items only. Qualifying items are shown on the Bundles and Deals collection page. The bundle discount cannot be combined with a discount code. If you return part of a bundle and the remaining items no longer meet the qualifying conditions, we will recalculate the order and deduct the value of the discount you received on the returned items from your refund, so that you keep only the discount you are entitled to on the items you kept.
Free delivery threshold
We offer free standard delivery on orders above a minimum value. The minimum value depends on your delivery destination and the currency in which you are shopping. The threshold that applies to you is displayed on our website and confirmed at checkout before you pay.
At the date of these Terms the thresholds are:
United Kingdom: £50 GBP
United States: $68 USD
Australia: $95 AUD
If we change a threshold, the threshold that applies to your order is the one displayed at the time you place it.
The threshold is assessed on the value of the goods in your order after any discounts have been applied, and before delivery charges and taxes. Free delivery applies to our standard delivery service only. Upgraded or express delivery is charged at the rate shown at checkout.
If you return items and the value of the goods you keep falls below the free delivery threshold, we may deduct the standard delivery charge that would have applied to the order from your refund. We will not do this where you are cancelling a whole order under Section 11, where the goods are faulty, not as described or not fit for purpose, or where we sent you the wrong item.
SECTION 7 - GIFT CARDS
Gift cards are issued and delivered by email to the address you provide at checkout. Please check that the recipient's email address is correct before completing your purchase, as we may be unable to recover a card sent to the wrong address.
Gift cards do not expire.
Gift cards can be redeemed against the full value of an order, including delivery charges and taxes, at honeyandpaw.com only. They cannot be used in any other store or with any third party.
If your order costs more than the value of the gift card, you can pay the difference using any payment method we accept. If your order costs less, the remaining balance stays on the gift card for future use.
Gift cards cannot be exchanged for cash and are not refundable, except where the law of your country requires otherwise, or where you cancel an unredeemed gift card under Section 11 within 14 days of purchase.
Discount codes cannot be used to purchase gift cards.
Where you paid for goods using a gift card and we owe you a refund, we will refund the gift card portion as store credit to the original gift card or as a new gift card of equivalent value.
Treat a gift card like cash. We are not responsible for gift cards that are lost, stolen, destroyed or used without your permission. If you believe a gift card has been lost or used without your permission, contact us at contact@honeyandpaw.com. Where the card has not been redeemed, we may at our discretion cancel it and issue a replacement.
Gift cards may not be resold, and we may cancel any gift card that we reasonably believe has been obtained fraudulently or resold in breach of these Terms.
SECTION 8 - SHIPPING AND DELIVERY
Our delivery options, charges and estimated timescales are set out on our Shipping and Returns page (https://honeyandpaw.com/pages/shipping-returns).
Delivery times
Delivery times quoted on the Services are estimates and are not guaranteed. Unless we agree otherwise with you, we will deliver your order to the address you provide within 30 days of the day on which the contract is formed.
If delivery is delayed
If we fail to deliver within that period, you may set a new reasonable deadline for delivery, and if we fail to meet that deadline you may treat the contract as at an end and we will refund you in full for any goods not delivered. If the delivery date was essential, for example because you told us at the time of ordering that the goods were needed for a specific occasion, you may treat the contract as at an end straight away. Nothing in this section limits any greater right you have under the consumer law of your country.
Risk and ownership
The goods remain our responsibility until they come into your physical possession, or into the physical possession of a person you have nominated to receive them, other than the carrier. Risk passes to you at that point. Ownership of the goods passes to you once we have received payment in full and the goods have been delivered, whichever happens later.
If your order does not arrive, or arrives damaged, contact us at contact@honeyandpaw.com and we will put it right. Please contact us within a reasonable time of the expected delivery date so that we can investigate with the carrier.
Delivery details and failed deliveries
You are responsible for providing a complete and accurate delivery address. If nobody is available to take delivery, the carrier will normally leave a card or send a notification explaining how to rearrange delivery or collect the goods. If, after a failed delivery, you do not rearrange delivery or collect the goods from the carrier, and the goods are returned to us, we will contact you for further instructions. Where the goods are returned to us because you did not collect them or provided an incorrect address, we may charge you the reasonable direct cost of the failed delivery and any return carriage before redelivering, or deduct that cost from any refund.
SECTION 9 - INTERNATIONAL ORDERS, CUSTOMS AND IMPORT CHARGES
We ship to the United Kingdom, the United States and Australia. We may add or remove destinations at any time. Current destinations and charges are shown at checkout and on our Shipping and Returns page (https://honeyandpaw.com/pages/shipping-returns).
Where an order crosses a customs border, it may be subject to import duties, taxes, brokerage fees and customs charges levied by the destination country. Unless the checkout expressly states that duties and taxes are included in the price you pay us, these charges are your responsibility and are payable in addition to the price of your order. We have no control over these charges and cannot predict their amount. Please check the requirements of your destination country before ordering.
You are the importer of record for international orders and are responsible for complying with the laws and regulations of the destination country. Some products cannot lawfully be imported into some countries. If an order is delayed, seized, destroyed or returned by customs because it does not comply with local requirements, or because import charges were not paid, we may deduct the delivery and return carriage costs we have incurred from any refund we owe you.
International delivery estimates exclude time spent in customs clearance, which is outside our control.
SECTION 10 - PRODUCT SAFETY AND INTENDED USE
Our products are intended for use with pets and are not for human use or consumption. Please read all packaging, labels and instructions before use, and keep them for future reference.
Supervision
Toys, chews and enrichment products are not indestructible. No toy is suitable for every pet. Always supervise your pet with a new product, choose products appropriate to your pet's size, age, strength and chewing style, and inspect products regularly. Stop using and safely dispose of any product that is damaged, worn, or has parts that have come loose, as these can present a choking or blockage risk. Keep small parts and packaging away from children and pets.
Fit and sizing
Collars, harnesses, leads, apparel, carriers, life jackets and similar products must be fitted and sized correctly. Please check our sizing guidance and measure your pet before ordering. Check the fit regularly, particularly for growing animals. Safety products such as reflective gear and life jackets reduce risk but do not remove it, and they are not a substitute for supervision, training or common sense around traffic or water.
Grooming, health and wellness products
Grooming and wellness products, including ear cleaners, waterless shampoos, dental wipes, pheromone diffusers and similar items, are intended for external use as directed on the packaging. They are general care and comfort products. They are not veterinary medicines, they are not intended to diagnose, treat, cure or prevent any disease or condition, and they are not a substitute for professional veterinary advice.
If your pet is unwell, injured, pregnant, elderly, very young, or receiving veterinary treatment, speak to your vet before using any new product. Stop use and contact your vet if your pet shows any adverse reaction. Patch test where the instructions recommend it. Keep all such products out of reach of children and animals.
Electrical products
Electrical products, including feeders, fountains and cameras, must be used in accordance with the instructions supplied, with the correct power supply for your country, and inspected regularly for damage to cables and connections. Do not use a damaged electrical product.
Information on the Services
Any care advice, guidance or general information published on the Services is provided for general interest only. It is not veterinary advice and should not be relied on as such. Always consult a qualified veterinary professional about your pet's health.
Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud, for defective products under applicable product liability law, or for any other liability that cannot be excluded or limited by law.
SECTION 11 - YOUR RIGHT TO CANCEL
If you are a consumer in the United Kingdom, you have a legal right to cancel your order within 14 days without giving any reason. This right is in addition to our returns policy in Section 12 and does not replace it.
If you are in the United States or Australia, this statutory cancellation right does not generally apply to online purchases, but our 30 day returns policy in Section 12 does, and so do your consumer rights in Section 13.
When the cancellation period ends
The cancellation period ends 14 days after the day on which you, or a person you have nominated other than the carrier, takes physical possession of the goods. If your order is delivered in more than one shipment, the period ends 14 days after you receive the last item.
How to cancel
Tell us clearly that you have decided to cancel before the 14 day period ends. Email contact@honeyandpaw.com with your order number, or use the model cancellation form at the end of these Terms. You do not have to give a reason. To meet the deadline, it is enough that you send your message before the period expires.
Returning the goods
You must send the goods back to us without undue delay and in any event within 14 days of telling us you wish to cancel.
You will bear the direct cost of returning the goods. You can either arrange and pay for your own return, or ask us for a prepaid return label and we will deduct the cost of that label from your refund. If you arrange your own return, please use a tracked service and keep proof of postage, as you are responsible for the goods until they reach us.
The direct cost of return, and the cost of our prepaid label, is:
Standard parcels: £5.99 GBP, $7.99 USD, $11.99 AUD
Bulky items such as cat trees, large beds and furniture: £15.99 GBP, $21.99 USD, $32.99 AUD
You will not pay any return carriage where the goods are faulty, not of satisfactory or acceptable quality, not as described, not fit for purpose, or where we sent you the wrong item. In those cases we cover the full cost of the return.
Your refund
We will refund all payments we received from you, including the cost of standard delivery. Where you chose a more expensive delivery option, we will refund the cost of our standard option rather than the upgraded one. We will make the refund without undue delay and no later than 14 days after the day we receive the goods back from you, or 14 days after you supply evidence that you have sent them back, whichever is earlier. We will refund using the same payment method you used for the original transaction, and you will not pay any fee as a result.
Handling the goods
You may handle the goods as you would in a shop in order to check their nature, characteristics and functioning. You are only liable for any reduction in the value of the goods that results from handling beyond that.
Exceptions
The right to cancel does not apply to goods made to your specification or clearly personalised, or to sealed goods that are not suitable for return for health protection or hygiene reasons where they have been unsealed after delivery.
SECTION 12 - RETURNS, REFUNDS AND EXCHANGES
Separately from any statutory right to cancel, we offer a 30 day returns window on unused, resaleable items in their original packaging. Full details, including how to start a return, who pays return carriage, the return address and refund timescales, are set out in our Refund Policy (https://honeyandpaw.com/pages/refund-policy).
The 30 day window runs from the day you receive your order.
Where you return an item under this policy because you have changed your mind, you bear the cost of return carriage on the same basis as set out in Section 11. Where an item is faulty, not as described, not fit for purpose, or is not the item you ordered, we cover the cost of the return.
Our returns policy is offered in addition to your legal rights and does not affect them. If an item is faulty, not as described, or not fit for purpose, your statutory rights under Section 13 apply, and they are not limited by the 30 day window or by any condition about packaging.
SECTION 13 - YOUR CONSUMER RIGHTS
Nothing in these Terms of Service affects your rights under the consumer protection laws of the country in which you live. Where any provision of these Terms conflicts with a right you have under those laws, that right prevails.
If you are in the United Kingdom
Under the Consumer Rights Act 2015, goods we supply must be of satisfactory quality, fit for purpose and as described. If they are not, you have a short term right to reject the goods and obtain a full refund within 30 days of receiving them, and after that you may be entitled to a repair, a replacement, a price reduction or a refund. These rights cannot be excluded or limited, and detailed advice is available from Citizens Advice.
If you are in Australia
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Any voluntary warranty or returns policy we offer is in addition to, and does not limit, those guarantees.
If you are in the United States
Your rights vary by state. Some states do not allow the exclusion or limitation of implied warranties, or the exclusion or limitation of certain damages. Where that is the case, the exclusions and limitations in Sections 27 and 28 apply to you only to the extent permitted in your state, and you may have additional rights.
SECTION 14 - COMPLAINTS AND DISPUTE RESOLUTION
If something has gone wrong, please tell us so that we can put it right. Email contact@honeyandpaw.com with your order number and a description of the problem, together with photographs where relevant.
We aim to acknowledge every complaint within 2 business days and to resolve it within 14 days. If a complaint is more complex and will take longer, we will tell you why and keep you updated. We will provide a final response within 8 weeks.
If we cannot resolve your complaint between us, you may be able to take the matter further:
United Kingdom: we are not currently a member of an alternative dispute resolution scheme and do not currently agree to use one. You can get free, independent advice from Citizens Advice, and you retain the right to take court proceedings. The EU Online Dispute Resolution platform closed in July 2025 and is no longer available.
Australia: you can contact the Australian Competition and Consumer Commission or the fair trading or consumer affairs office in your state or territory.
United States: you can contact the consumer protection office of your state attorney general.
You always retain the right to bring court proceedings, as set out in Section 31.
SECTION 15 - REVIEWS AND FEEDBACK
If you submit, upload, post, email or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans or other content (together, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium for any purpose, including commercial use. We may use this licence to operate, provide, evaluate, improve and promote the Services.
You confirm that: (a) you own or have all necessary rights to your Feedback; (b) you have disclosed any payment, free product, discount or other incentive you received in connection with submitting it; and (c) your Feedback complies with these Terms.
We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it.
Our approach to reviews. We do not pay for positive reviews, we do not write or commission fake reviews, and we do not remove or suppress a review simply because it is negative. Where a review has been submitted in connection with a free product, discount or other incentive, we will label it accordingly. We may remove Feedback that is unlawful, offensive, threatening, defamatory, obscene, that infringes someone else's rights, that is not a genuine account of experience with the product, or that otherwise breaches these Terms.
You agree that your Feedback will not infringe any right of any third party, including copyright, trademark, privacy or other personal or proprietary rights, will not be unlawful, abusive or obscene, and will not contain any virus or other malicious code. You may not use a false email address, pretend to be someone else, or otherwise mislead us or others about the origin of your Feedback. You are responsible for your Feedback and its accuracy. We take no responsibility for Feedback posted by you or any third party.
SECTION 16 - INTELLECTUAL PROPERTY
The Services, including all trade marks, brands, text, displays, images, graphics, product descriptions, reviews, video and audio, and the design, selection and arrangement of them, are owned by Honey & Paw, its affiliates or its licensors, and are protected by copyright, trade mark, design and other intellectual property laws in the United Kingdom, the United States, Australia and elsewhere.
These Terms permit you to use the Services for your personal, non commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on the Services without our prior written consent, except that your browser or device may make temporary copies as part of normally viewing the Services.
Except as expressly provided in these Terms, nothing grants you a licence or other rights under any patent, trade mark, copyright or other intellectual property of Honey & Paw, Shopify or any third party. Unauthorised use of the Services may breach intellectual property laws. All rights not expressly granted are reserved.
Honey & Paw's names, logos, product and service names, designs and slogans are trade marks of Honey & Paw or its affiliates or licensors, and you must not use them without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trade marks of Shopify. All other names, logos, product and service names, designs and slogans on the Services are the trade marks of their respective owners.
SECTION 17 - OPTIONAL THIRD PARTY TOOLS
You may be given access to third party tools through the Services that we neither monitor nor control.
We provide access to those tools "as is" and "as available", without warranties, representations or conditions of any kind and without endorsement. We have no liability arising from or relating to your use of optional third party tools.
Any use of these tools is at your own risk and discretion, and you should make sure you are familiar with, and agree to, the terms on which the relevant third party provides them.
We may offer new features through the Services in future, including new tools and resources. Those features will form part of the Services and will be subject to these Terms.
SECTION 18 - THIRD PARTY LINKS
The Services may contain materials and links to websites operated by third parties, including embedded third party functionality. We are not responsible for examining or evaluating the content or accuracy of third party materials or websites. If you leave the Services to access them, you do so at your own risk.
We are not liable for any harm or damage relating to your access to third party websites, or your purchase or use of any products, services, resources or content on them. Please review the third party's policies and practices before you engage in any transaction with them. Complaints, claims or questions about third party products and services should be directed to that third party.
SECTION 19 - RELATIONSHIP WITH SHOPIFY
Honey & Paw is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Honey & Paw. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Honey & Paw, including any injury, damage or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Honey & Paw.
SECTION 20 - PRIVACY
All personal information we collect through the Services is subject to our Privacy Policy (https://honeyandpaw.com/pages/privacy-policy), and certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit will be transmitted to and shared with Shopify and with third parties that may be located in countries other than the one in which you live, in order to provide services to you. Our Privacy Policy (https://honeyandpaw.com/pages/privacy-policy) explains how we, Shopify and our partners use your personal information, and sets out the rights you have over it.
SECTION 21 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on the Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, delivery charges, transit times or availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information at any time without prior notice.
Where a product is listed at an incorrect price or with incorrect information because of an error, and the error is one that you could reasonably have recognised as a mispricing, we may decline or cancel the order and refund you in full. If we have already dispatched the goods, we will not seek any further payment from you.
SECTION 22 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly:
(a) for any unlawful or malicious purpose;
(b) to breach any international, federal, state, provincial or local law, regulation, rule or ordinance;
(c) to infringe our intellectual property rights or those of others;
(d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate or threaten any of our employees or any other person;
(e) to transmit false or misleading information;
(f) to send, receive, upload, download, use or re-use any material that does not comply with these Terms;
(g) to transmit, or procure the sending of, any advertising or promotional material, including junk mail, chain letters or spam;
(h) to impersonate or attempt to impersonate any other person or entity;
(i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which may harm Honey & Paw, Shopify or users of the Services, or expose them to liability;
(j) to upload or transmit viruses or any other malicious code that will or may affect the functionality or operation of the Services;
(k) to reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services;
(l) to collect or track the personal information of others;
(m) to spam, phish, pharm or pretext the Services;
(n) to use any robot, spider, scraper, data gathering or extraction tool, automated device or process, or any artificial intelligence or agentic AI tool, to access, monitor, copy or index the Services, except as permitted under Section 23; or
(o) to interfere with, bypass or circumvent the security or authorisation features, robot exclusion headers, or other measures we use to restrict access to the Services.
We may suspend, disable or terminate your account at any time, without notice, if we reasonably determine that you have breached this section.
SECTION 23 - PERMITTED AUTOMATED ACCESS
Section 22(n) does not apply to:
(a) search engines, shopping and product feed crawlers, price comparison services, social media link preview crawlers, and similar services, to the extent that they access the Services in accordance with the instructions in our robots.txt file and any other machine readable access controls we publish;
(b) browsers, accessibility tools and assistive technologies used by you to access the Services in the ordinary way; and
(c) any other automated access we have authorised in writing.
We may withdraw or limit this permission for any particular service at any time, including by updating our robots.txt file or by notifying the operator directly.
SECTION 24 - AGENTS
24.1 Subject to Section 24.5, this section (the "Agent Terms") applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with the Services. "Agent" means any software or service that takes autonomous or semi autonomous action on behalf of, or at the instruction of, any person or entity, and that can be executed on behalf of a person or using a person's device without direct supervision.
24.2 No Agent may access, use or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with Section 24.4. In addition, no Agent may access, use or interact with the Services if we have asked it to refrain from doing so.
24.3 We may limit, including by technical measures, whether and how any Agent accesses, uses and interacts with the Services.
24.4 Agents must: (i) in all HTTP and HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including "Agent/[agent name]" in the request's user agent string; (ii) not conceal or obfuscate that any access, use or interaction is from an Agent, including by mimicking human behaviour and interaction patterns, or by completing or circumventing CAPTCHAs or other measures intended to distinguish automated use from human use; (iii) respond truthfully to any question or prompt seeking to determine whether interactions are coming from a human or a computer; and (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify or control whether and how Agents access, use or interact with the Services.
24.5 This section does not apply to any access permitted under Section 23, which is governed by that section instead. For the avoidance of doubt, nothing in this section requires a search engine, shopping feed crawler or similar service operating in accordance with our robots.txt file to identify itself as an Agent or to modify its user agent string.
SECTION 25 - EVENTS OUTSIDE OUR CONTROL
We are not liable for any failure or delay in performing our obligations under these Terms where that failure or delay results from an event outside our reasonable control. This includes strikes, lockouts or other industrial action; civil commotion, riot, terrorist attack or war; fire, flood, storm, extreme weather, earthquake, subsidence, epidemic or other natural disaster; failure of public or private telecommunications networks; and the acts, decrees or restrictions of any government, port or customs authority.
If such an event occurs, we will contact you as soon as reasonably possible to tell you, and our obligations will be suspended for the duration of the event. Where the event affects delivery of goods to you, we will arrange a new delivery date once the event is over. You may contact us to cancel the contract and receive a refund for any goods you have paid for but not received if the delay is substantial.
SECTION 26 - TERMINATION
We may terminate this agreement, or your access to the Services or any part of them, at our discretion at any time and without notice, and you will remain liable for all amounts due up to and including the date of termination. Where you have an accepted order that we have not yet fulfilled, termination does not affect that order unless we cancel it and refund you in full.
The following sections continue to apply after termination: Product Safety and Intended Use, Your Consumer Rights, Reviews and Feedback, Intellectual Property, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, General Terms, Governing Law and Jurisdiction, Privacy, and any other provision that by its nature should survive termination.
SECTION 27 - DISCLAIMER OF WARRANTIES
Nothing in this section or in Section 28 excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; breach of the terms implied by the Consumer Rights Act 2015 or any other statutory rights you have as a consumer; liability under the Australian Consumer Law that cannot lawfully be excluded; defective products under applicable product liability law; or any other liability that cannot be excluded or limited by the law of the country in which you live.
Information presented on or through the Services is made available for general information purposes. We do not warrant that it is accurate, complete or useful, and any reliance you place on it is at your own risk.
Subject to the paragraph above, and to the fullest extent permitted by law, the Services and all products offered through the Services are provided "as is" and "as available" for your use, without any representation, warranty or condition of any kind, express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non infringement. We do not guarantee, represent or warrant that your use of the Services will be uninterrupted, timely, secure or error free. Some jurisdictions do not allow the exclusion of implied or other warranties, so the exclusions in this paragraph may not apply to you.
SECTION 28 - LIMITATION OF LIABILITY
Nothing in this section excludes or limits any liability listed in the first paragraph of Section 27.
Subject to that, and to the fullest extent permitted by law, in no case shall Honey & Paw, our partners, directors, officers, employees, affiliates, agents, contractors, service providers or licensors, or those of Shopify and its affiliates, be liable for any injury, loss, claim, or any indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, replacement costs or similar damages, whether based in contract, tort including negligence, strict liability or otherwise, arising from your use of the Services or any products bought through them, or for any other claim relating in any way to your use of the Services or any product, including any errors or omissions in any content, or any loss or damage incurred as a result of the use of the Services or any content or product posted, transmitted or otherwise made available through the Services, even if advised of their possibility.
If you are a consumer, we are responsible to you for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen, or if, at the time the contract was made, both we and you knew it might happen.
We supply our products for domestic and private use. If you use them for any commercial or business purpose, we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the limitations in this section may not apply to you in full.
SECTION 29 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Honey & Paw, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, payable to any third party arising out of: (1) your breach of these Terms of Service or the documents they incorporate by reference; (2) your breach of any law or the rights of a third party; or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, and a failure to notify you promptly will not relieve you of your obligations unless you are materially prejudiced by it. We may control the defence and settlement of such a claim at your expense, including choice of counsel, but we will not settle a claim that requires non monetary obligations from you without your consent, which you must not unreasonably withhold. You will cooperate in the defence of indemnified claims, including by providing relevant documents.
This section does not apply to you where you are acting as a consumer, and nothing in it affects your statutory rights.
SECTION 30 - GENERAL TERMS
Severability. If any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision will still be enforceable to the fullest extent permitted by law, the unenforceable part will be treated as severed, and the validity and enforceability of the remaining provisions will not be affected.
Waiver. Our failure to exercise or enforce any right or provision of these Terms is not a waiver of that right or provision.
Entire agreement. These Terms of Service, together with any policies or operating rules we post on this site, form the entire agreement between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, including any earlier version of these Terms. Nothing in this paragraph limits your rights in respect of any fraudulent misrepresentation.
Ambiguities. Any ambiguity in the interpretation of these Terms will not be construed against the drafting party.
Assignment. You may not delegate, transfer or assign these Terms or any of your rights or obligations under them without our prior written consent, and any attempt to do so will be void. We may transfer, assign or delegate these Terms and our rights and obligations under them, provided that this does not affect your rights under these Terms or under law. We will tell you if this happens.
Third parties. Except as expressly stated, these Terms do not give any person other than you and us the right to enforce any of their provisions.
Headings. Headings are included for convenience only and do not limit or otherwise affect these Terms.
SECTION 31 - GOVERNING LAW AND JURISDICTION
These Terms of Service, any separate agreement under which we provide you the Services, and any dispute or claim arising out of or in connection with them or their subject matter, including non contractual disputes or claims, are governed by and shall be construed in accordance with the laws of England and Wales.
You and Honey & Paw agree that the courts of England and Wales have non exclusive jurisdiction to settle any such dispute or claim.
If you are a consumer, nothing in this section affects your rights under the mandatory consumer protection laws of the country in which you live, and you may bring proceedings in the courts of that country. If you live in Scotland you may also bring proceedings in the Scottish courts, and if you live in Northern Ireland you may also bring proceedings in the Northern Irish courts.
Nothing in these Terms limits the application of the Australian Consumer Law to customers in Australia, or the application of the consumer protection laws of your state if you are in the United States.
SECTION 32 - CHANGES TO THESE TERMS OF SERVICE
You can review the most current version of these Terms of Service at any time on this page.
We may update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check this page periodically. We will notify you of material changes in accordance with applicable law, and those changes will take effect on the date specified in the notice. Your continued use of, or access to, the Services after changes are posted constitutes acceptance of them.
The Terms that apply to your order are the Terms in force at the time you placed it. Changes to these Terms do not apply retrospectively to orders we have already accepted.
